Terms of Service — Marketing Batch LLC

These Terms of Service (“Terms”) govern your use of our website, services, and all interactions with Marketing Batch LLC (“we”, “our”, or “us”). By using our services or accessing our site, you agree to be legally bound by these Terms.

1. Services We Provide

Marketing Batch LLC offers digital marketing and front-office services, including but not limited to:

  • Digital marketing strategy & execution
  • SEO, content, branding, and design
  • Website development
  • Facebook & Google Ads management
  • Call center & virtual front desk (BPO) services
  • Email marketing and CRM automation
  • Business development consulting

Service terms (scope, pricing, duration) are confirmed per project or subscription agreement.

2. Payment Terms

a. Monthly Retainers

  • Invoices are billed in advance and must be paid before work begins for the period.
  • Late or missed payments may result in paused services.

b. Annual Plans

  • Clients purchasing full-year services up front receive discounted pricing.
  • Annual service plans are non-refundable once work begins.

c. Refunds & Work Completion

  • For month-to-month clients: Only the undelivered portion of work may be eligible for a partial refund.
  • Any work already delivered (e.g., ad setup, design, calls, consultation) is non-refundable.

3. Client Responsibilities

Clients must:

  • Provide timely access to necessary accounts (e.g., Ads Manager, CRM, website)
  • Respond to requests, approvals, or content feedback within reasonable timeframes
  • Not share unauthorized access to licensed platforms or content
  • Disclose any applicable industry compliance needs (e.g., HIPAA)

4. Platform Access & Tools

If our team provides you with access to dashboards or platforms (e.g., Facebook Ads Manager, Google Ads, GoHighLevel), you agree to:

  • Follow the respective platform’s terms
  • Not hold us liable for downtime, platform bans, or third-party errors

5. Data Use & Confidentiality

  • All business information, strategies, or documents shared by either party will be treated as confidential.
  • We may showcase anonymized project outcomes or success metrics for portfolio or marketing purposes, unless otherwise agreed.

6. Limitation of Liability

Marketing Batch LLC shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services, platforms, or content.
Maximum liability shall be limited to the total fees paid for the specific service in question.

7. Termination

  • Clients may cancel monthly services with 7 days written notice prior to the next billing cycle.
  • Annual contracts may include a separate clause or written agreement regarding cancellation.
  • We reserve the right to terminate any client engagement due to non-payment, abuse, or policy violations.

8. Jurisdiction & Legal

This agreement shall be governed by and interpreted under the laws of the State of Texas, USA.

Any legal disputes shall be resolved in the appropriate courts located in Austin, Texas.

9. Updates to Terms

These Terms may be updated periodically. Any material changes will be posted on this page with an updated “Last Updated” date.
